1. Intellectual Property Ownership

⚠️ IP Ownership Notice

All intellectual property described on this page is owned exclusively and personally by the Founder and sole inventor of BrainPredict (natural person — 100% DEMPE functions). BrainPredict OÜ (Registry Code: EE17352111) is the operating entity and is directed by the Founder as sole director. No IP licence agreement has been granted by the Founder to BrainPredict OÜ or to any other party as of April 16, 2026.All IP rights, including but not limited to the 95 pending patents, trade secrets, copyright, and know-how listed below, remain exclusively with the Founder personally.

The Founder owns all rights, title, and interest in:

  • Software: All 20 BrainPredict platform code bases, applications, and interfaces (including Platform #19 — BrainPredict Automation and the BrainPredict Living Organism add-on)
  • AI Models: All 560 AI models, algorithms, and machine learning architectures across 20 platforms
  • Intelligence Bus v10: Proprietary AI orchestration system with 2288 typed events, including otto.automation.* and otto.blo.* namespaces
  • Industrial AI IP: OPCUAIndustrialAdapter, ModbusTCPIndustrialAdapter, SetpointRecommender, triple-gate write-back architecture, and all related industrial AI methods
  • Living Organism IP: BLODataPoint generic data model, NetworkScanner ecosystem-wide discovery engine, DataQualityAuditor, ProcessBaseline, IssueIdentifier (10-category), RemediationEngine, and all BLO-phase implementations
  • Sentinel Safety OS: Proprietary 5-level runtime AI governance system enforcing 23 compliance frameworks
  • Documentation: User guides, API documentation, technical specifications, certification exams
  • Trademarks: "BrainPredict", "OTTO", "BrainPredict Automation", "BrainPredict Living Organism", logos, and brand assets
  • Patents — 106 pending (BP-001→BP-106): All innovations registered under Paris Convention (priority date: April 16, 2026 — e-Soleau depot_v17). Filed at EPO/PCT. Paris Convention priority established. See IP Protection Engine for 7-Lock infringement architecture detail.
  • Trade Secrets: Proprietary methodologies, BrainCore architecture, Raphael Engine, Intelligence Bus event taxonomy, OTTO routing tables, and all know-how — protected under EU Directive 2016/943, French Loi n°2018-670, US DTSA 18 USC §1836, and Estonian KarS §207.

2. Customer's Intellectual Property

Customer retains all rights to:

  • Customer Data: All data uploaded to BrainPredict services
  • AI Outputs: Predictions, insights, and reports generated by AI models
  • Custom Configurations: Custom workflows, dashboards, and settings
  • Business Intelligence: Insights and knowledge derived from using BrainPredict

Important:

BrainPredict makes NO claim to your data or AI outputs. You own 100% of your data and can export it anytime.

3. License Grant to Customer

Chain of authority: The BrainPredict IP is owned in full by the Founder and sole inventor as a natural person. No IP licence has been granted to BrainPredict OÜ or any third party. BrainPredict OÜ, as the operating company directed by the Founder (sole director), is authorised by the Founder to make the SaaS service available to Customer under the limited end-user right described below. No IP rights are transferred to BrainPredict OÜ or to Customer.

BrainPredict OÜ grants Customer a limited, non-exclusive, non-transferable, revocable right to use the service to:

  • Access and use BrainPredict services for internal business purposes
  • Use AI models to generate predictions and insights
  • Access documentation and support materials
  • Use BrainPredict APIs within subscription limits

License Restrictions: This license does NOT permit:

  • Reverse engineering, decompiling, or disassembling any part of the BrainPredict software — subject to DMCA §1201 anti-circumvention enforcement
  • Copying, modifying, or creating derivative works
  • Reselling, sublicensing, or white-labeling services
  • Removing copyright notices, proprietary markings, or algorithmic fingerprints embedded in API outputs
  • Using services to build competing products — BrainPredict's 7-Lock architecture makes any competitive enterprise AI OS infringe ≥1 of the 95 patents pending
  • Circumventing, disabling, or bypassing any BrainPredict technological protection measure (honeypots, canary tokens, integrity checks, watermarks) — constitutes DMCA §1201(a)(1) violation
  • Systematic API probing, endpoint enumeration, or parameter fuzzing — constitutes trade secret misappropriation under EU Directive 2016/943 and DTSA

4. Trademark Usage

Customer may reference BrainPredict in marketing materials with these guidelines:

  • Permitted: "Powered by BrainPredict", "Uses BrainPredict AI", "BrainPredict Customer"
  • Not Permitted: Implying endorsement, partnership, or affiliation without written approval
  • Logo Usage: Request logo files and brand guidelines from info@brainpredict.ai
  • Trademark Symbol: Always use ® or ™ when referencing BrainPredict trademarks

5. Copyright Infringement

If you believe your copyright has been infringed, notify us with:

  1. Description of copyrighted work
  2. Location of infringing material
  3. Your contact information
  4. Statement of good faith belief
  5. Statement of accuracy under penalty of perjury
  6. Physical or electronic signature

6. Open Source Components

BrainPredict uses certain open source components under their respective licenses:

  • Python libraries (Apache 2.0, MIT, BSD licenses)
  • React and Next.js (MIT license)
  • PostgreSQL (PostgreSQL License)
  • Redis (BSD license)

5b. Anti-Circumvention — DMCA §1201 + EU Directive 2016/943

BrainPredict deploys the following technological protection measures (TPMs) under DMCA 17 USC §1201and EU Directive 2016/943 (Trade Secrets). Circumventing, disabling, or bypassing any of these constitutes a criminal offence in France, Estonia, the United States, and the United Kingdom, in addition to civil liability.

Deployed Technological Protection Measures:

  • Runtime Integrity Verification (Patent BP-094): HMAC-SHA3-256 verification of all deployed service files. Any modification or extraction is automatically detected and reported.
  • Algorithmic Fingerprinting (Patent BP-094): Every API prediction output carries an invisible algorithmic fingerprint (AFP) — a statistical marker in the confidence score. The AFP survives output copy-paste and proves BrainPredict origin in any third-party system.
  • Canary Tokens (Patent BP-095): Unique HMAC-SHA3-256 canary tokens are embedded in API responses. If these tokens appear in any non-BrainPredict context, automatic legal action is initiated. Activating a canary token constitutes evidence of trade secret exfiltration.
  • Honeypot Endpoints (Patent BP-095): BrainPredict deploys 8+ honeypot API endpoints. Access to these endpoints is forensically logged with full chain-of-custody Merkle evidence. There is no legitimate reason for any party to access these endpoints.
  • Trapdoor Computations (Patent BP-095): Honeypot responses include mathematically incorrect computations specifically designed to be detectable when integrated into a competing product. Detection proves direct copying of BrainPredict outputs.
  • Behavioral Fingerprinting (Patent BP-094): API usage patterns are recorded and analysed. Systematic probing behaviour consistent with reverse engineering generates an automated IP violation report filed with legal@brainpredict.ai.

The 7-Lock Infringement Architecture:

BrainPredict's IP portfolio is structured so that any competitive enterprise AI operating system must infringe at least one of BrainPredict's 95 pending patents. This is the result of 7 independent "locks" — each corresponding to a pattern that is legally mandatory for regulatory complianceand exclusively covered by BrainPredict patents:

  1. BP-001 — Intelligence Bus: Real-time typed event architecture for AI predictions. No commercially viable alternative to event-driven delivery at enterprise scale.
  2. BP-083 — EU AI Act Art.9 Gate: Structural production admission gate. Legally mandatory for high-risk AI under EU AI Act. No design-around compatible with regulatory requirements.
  3. BP-087 — HITL Workflow Gates: Risk-threshold human review in typed multi-agent workflows. Mandatory under GDPR Art.22 for automated high-impact decisions.
  4. BP-065 — SHAP+Merkle Audit: Explainability + tamper-proof audit. Mandatory under GDPR Art.22 (explanations) + EU AI Act Art.9 + DORA (immutable records).
  5. BP-090 — Kyber-768 IB Encryption: Post-quantum Kyber-768 on AI event bus. Becoming mandatory under EU Cyber Resilience Act (CRA) by 2027.
  6. BP-089 — DP-FedAvg Consortium: Federated learning with differential privacy for cross-company AI. Required by GDPR data minimisation principle (Art.5(1)(c)).
  7. BP-076 — BERT AI Routing: BERT-based intent routing for enterprise NLQ without external LLM. The universal pattern for privacy-preserving enterprise AI querying.

Notice to competitors:

If you are building a competing enterprise AI operating system, you are advised to contact legal@brainpredict.ai to discuss licensing before building, not after. Our IP protection systems are active and will generate evidence automatically. We will pursue all infringements under applicable patent, trade secret, and criminal law in all relevant jurisdictions.

5c. Patent Portfolio — 106 Patents Pending (BP-001→BP-106)

BrainPredict has filed 106 patents covering every layer of the BrainPredict AI Operating System. All patents filed under the Paris Convention (priority date: April 16, 2026). PCT international phase filing in progress. e-Soleau depot_v17 (INPI France) establishes priority.

If you provide feedback, suggestions, or ideas to BrainPredict:

  • You grant BrainPredict a perpetual, irrevocable, royalty-free license to use such feedback
  • BrainPredict may incorporate feedback into products without compensation
  • You waive any claims to compensation for implemented suggestions
